Terms of Service

These Terms of Service ("Terms") govern your access to and use of modelcollabs.com and the ModelCollabs application (the "Service"), operated by Domenico Creative Ideas LLC ("we", "us", "ModelCollabs"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

ModelCollabs provides identity verification and electronic release-signing tools. You can create release requests, invite recipients to verify their identity, and capture electronic signatures. Signed releases are delivered to your connected cloud storage (Google Drive, Dropbox, Box) and a tamper-evident copy is retained for compliance and audit purposes.

• You are responsible for the accuracy of any information you submit, including the recipient's contact information and any release content you generate.
• You confirm you have the recipient's permission to send them a notification (email or SMS) before submitting a release request that triggers one.
• You are responsible for any record-keeping obligations applicable to your business (including, where applicable, 18 U.S.C. § 2257 obligations). The Service helps you capture and organize records; legal compliance is your responsibility.
• You will not use the Service for any unlawful purpose or to harass any person.

Program name: ModelCollabs Release Notifications.

Program description:Transactional notifications sent when a recipient is invited to verify their identity and electronically sign a release form. Each SMS contains the sender's name and a unique verification URL specific to that recipient.

Message frequency: Recipients receive a single SMS per release request, plus at most one resend if the sender re-issues the invitation. We do not send marketing or promotional SMS.

Message and data rates: Message and data rates may apply.

Opt-out: Reply STOP to any message to opt out of SMS. Once you opt out, we will not send you further SMS messages from this program.

Help: Reply HELP to any message for assistance, or email dommy@modelcollabs.com.

Carriers: Carriers are not liable for delayed or undelivered messages.

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us at dommy@modelcollabs.com if you believe your account has been compromised.

You agree not to: (a) reverse-engineer or attempt to gain unauthorized access to the Service; (b) interfere with or disrupt the Service; (c) use the Service to send unsolicited messages or to send messages on behalf of someone who has not granted you permission; (d) use the Service to impersonate any person; (e) submit false or misleading identity verification information.

The Service, including its software, design, and content (excluding user-generated content), is owned by Domenico Creative Ideas LLC and protected by intellectual property laws. You retain all rights to the release content you generate using the Service.

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or for any lawful business reason, with reasonable notice where practical. Upon termination, you may request export of your data and deletion of your account by emailing dommy@modelcollabs.com.

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose. The Service is a tool to help you capture and organize releases; it is not a substitute for legal advice.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred U.S. dollars. We are not liable for indirect, incidental, special, consequential, or punitive damages.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Florida.

We may update these Terms. Material changes will be communicated via email to the address on your account, and the "Last updated" date above will reflect the most recent revision. Continued use after a change constitutes acceptance of the revised Terms.
